Intellectual Property Policy

BuyHappyThings.com takes intellectual property rights seriously. This policy explains our role as a marketplace, what constitutes IP infringement on our platform, how to report it, and how affected sellers can respond.

1. Our Role as a Marketplace

BuyHappyThings.com is a venue that connects independent sellers with buyers. We do not manufacture goods, hold inventory, or control what individual sellers list. Sellers are independent third parties responsible for ensuring that their listings, photos, and descriptions do not infringe the intellectual property rights of any third party.

We cannot make legal determinations about whether specific content infringes someone's intellectual property. We will, however, remove or disable listings when we receive a valid infringement report that complies with this policy.

2. Seller Responsibilities

As a seller, you are responsible for ensuring that:

  • Your listings are authentic. Only list genuine items. Do not list counterfeit, fake, or unauthorized replica products. Listing a counterfeit item as genuine — or misrepresenting its brand or manufacturer — violates both this policy and our Content & Listing Policy.
  • You use brand names accurately. You may use a manufacturer's name (e.g., Lionel, Bachmann, Atlas, Kato, MTH) to accurately describe an item you are selling. You may not use brand names to describe items that are not that brand, imply an official relationship with a brand, or use brand names as keywords to drive search traffic to unrelated items.
  • Your listing photos are your own. Only use photos that you took, or that you have clear permission to use. Do not copy product photos from manufacturer websites, other sellers, or stock image services without a license to do so.
  • Your descriptions are original. Do not copy descriptions verbatim from manufacturer catalogs or other listings without permission.

3. Reporting Intellectual Property Infringement

If you are an intellectual property owner (or authorized representative) and believe that a listing on BuyHappyThings.com infringes your rights, you may submit an infringement report to:

Your report must include:

  • Identification of the intellectual property right you claim is being infringed (e.g., a specific copyright registration, trademark registration, or a description of your rights).
  • A link to each listing you believe infringes your rights.
  • Your full name, company name (if applicable), email address, and mailing address.
  • A statement that you have a good-faith belief that the use of the material is not authorized by the rights owner, its agent, or the law.
  • For DMCA copyright claims: a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. Your physical or electronic signature is also required.

We may request additional information before processing a report. We will reject reports that appear to be false, fraudulent, incomplete, or submitted in bad faith.

4. What Happens After a Report

When we receive a valid infringement report, we will:

  • Remove or disable access to the allegedly infringing listing.
  • Notify the affected seller that their listing was removed, and why.
  • Provide the seller with information on how to submit a counter notice if they believe the removal was in error.

5. Counter Notices (DMCA)

If your listing was removed due to a copyright infringement report and you believe the removal was incorrect, you may submit a DMCA counter notice to legal@buyhappythings.com. Your counter notice must include:

  • Identification of the removed material and where it appeared.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • Consent to jurisdiction of the federal district court for your judicial district (or, if outside the US, any judicial district in which BuyHappyThings.com may be found).
  • Your physical or electronic signature.

If we receive a valid counter notice, we will provide a copy to the original complainant. The removed material may be restored no sooner than 10 business days after we receive the counter notice, unless the complainant files a court action and notifies us.

6. Repeat Infringement

Sellers who receive multiple valid IP infringement reports risk permanent suspension of their selling privileges. We will consider the circumstances of each case, but a pattern of IP violations is grounds for account termination. Sellers who attempt to create a new account after termination for IP violations may be permanently barred from the platform.

7. Trademark Misuse by Sellers

Toy train brands (such as Lionel, Bachmann, Atlas, Kato, MTH, Walthers, and others) are registered trademarks. Using a brand name in your listing title or description for an item that is not genuinely that brand — for example, calling a generic part a "Lionel part" when it is not — is trademark infringement and violates our Content & Listing Policy. We will remove such listings and may take further action against the seller.
